1.1 Acceptance
By booking or participating in any activity with Ocean Tribe Scuba (“we”, “us”, “our”), you agree to these policies. This forms a legally binding agreement.
1.2 Nature of Activities
Scuba diving, snorkeling, and marine activities involve inherent risks, including injury, illness, or death. Participation is voluntary and at your own risk.
1.3 Medical Fitness
Participants must:
- Provide accurate medical information
- Be physically and mentally fit to dive
- We may refuse participation if safety concerns arise or if a required medical clearance is not provided.
1.4 Certifications & Conduct
- Certified divers must present valid certification
- All participants must follow instructor and crew instructions at all times
- Unsafe behavior may result in removal without refund
1.5 Alcohol & Drug Policy
- Participation under the influence of alcohol or drugs is strictly prohibited
- A minimum of 12 hours must pass between alcohol consumption and diving
- We reserve the right to refuse service without refund if impairment is suspected
1.6 Environmental Responsibility
Participants must:
- Avoid touching or harming marine life
- Not remove marine objects
- Maintain proper buoyancy
- Follow all local environmental regulations
- Non-compliance may result in removal without refund.
1.7 Equipment Use
- All equipment must be handled responsibly.
- Participants may be charged for loss or damage caused by negligence or misuse.
1.8 Weather & Operations
All activities are subject to weather, sea conditions, and operational factors. Plans may change in the interest of safety.
1.9 Liability
To the maximum extent permitted by law:
- Participation is at your own risk
We are not liable for indirect or consequential damages
Liability is excluded except in cases of gross negligence or legal obligation - A liability waiver must be signed before participation.

1.10 Insurance
Participants are strongly advised to obtain personal dive and travel insurance. We are not responsible for medical, evacuation, or travel-related costs.
1.11 Media Use
Photos or videos may be taken during activities and used for promotional purposes. You may opt out by informing us in writing before your activity.
2. Privacy Policy
2.1 Information Collected
We may collect:
- Name and contact details
- Booking and payment information
- Medical and fitness details
- Diving certifications
2.2 Purpose of Use
Your information is used to:
- Manage bookings and services
- Ensure safety during activities
- Communicate important updates
- Meet legal and operational requirements
2.3 Legal Basis (GDPR-Aligned)
We process data based on:
- Contractual necessity
- Legal obligations
- Legitimate interests
- Consent (where applicable)
2.4 Data Sharing
We may share necessary information with:
- Certification agencies (e.g., PADI/SSI)
- Payment processors
- Emergency services if required
We do not sell personal data.
2.5 Data Retention & Security
Data is retained only as long as necessary. Appropriate security measures are in place to protect your information

- Deletion of your data
- Withdrawal of consent
3. Refund & Cancellation Policy
3.1 Booking Confirmation
All dive programs require advance booking and payment to confirm your slot.
3.2 Cancellation by Customer
- 7 days or more before dive date: 100% refund of advance
- 2–7 days before dive date: 80% refund of advance
- Within 24 hours / No-show: No refund
- Cancellation is valid only when received through official communication channels.
3.3 Rescheduling
- One-time rescheduling is allowed if requested at least 24 hours in advance, subject to availability
- Rescheduled bookings are non-refundable
- Requests within 24 hours are treated as cancellations
3.4 Late Arrival
Late arrival may result in missed or shortened activities without refund.
3.5 Cancellation by Ocean Tribe Scuba
If an activity is cancelled due to weather, safety, or operational reasons, you may choose:
A full refund, OR
Rescheduling at no additional cost
3.6 Non-Refundable Situations
Refunds will not be provided for:
- Medical unfitness or undisclosed conditions
- Failure to provide required documents or certifications
- Refusal to follow instructions
- Withdrawal after the activity has started
- Change of mind at or after the dive
3.7 Force Majeure
We are not liable for disruptions caused by events beyond our control, including weather, natural disasters, government restrictions, or travel issues. Rescheduling or credit may be offered where possible.
3.8 Refund Processing
Approved refunds are processed within 7–14 business days. Applicable transaction fees may be deducted.

By confirming your booking, you acknowledge that you have read and agreed to this policy.
